Napeague Beach Stretch to Remain Open - At Least for Now

Accoring to report, judge issues against closing beach while case goes to trial phase.

According to a report on 27East.com, East Hampton Town Trustees and the Town Board won a victory - for now - when a State Supreme Court Justice ruled against closing a 220-foot stretch of beach in Napeague to the public while the case goes to trial.

The report states the following:

On Thursday, October 13, Justice Melvyn Tanenbaum ordered the lawsuit brought by the White Sands Motel in 2009 to proceed to the pre-trial phase. The decision represents a denial of a request the plaintiff made in March, asking the justice to rule on the case without holding a trial and issue a preliminary injunction barring people from accessing the beach in front of the motel.

From here, the case will proceed to trial next year, according to the report.

The Town Board and Trustees are also in litigation regarding a nearby 4000-foot stretch of beach.
