Disciplinary charges were lodged against Penny on Dec. 7 by Town Attorney John Jilnicki pursuant to New York Civil Service Law, the resolution further states.

Reached at home in Sag Habror soon after the resolution was passed, Penny said his office had received a fax notifying him of the resolution. "Obviously, I'm not going to take this lying down," he said.

Penny said he didn't know what had prompted the suspension, only that the notification mentioned something about insubordination, but he wasn't quite sure.
