Town Police: Cocaine Found in Montauk Driver's Car

Also: Boater charged with operating a vessel while intoxicated.

The following information was supplied by the East Hampton Town Police Department. A criminal charge is only an accusation and does not indicate guilt.

• Daniel P. Fagan, 34, of Montauk, was arrested after police said he was driving in Montauk under the influence of drugs and with cocaine in the car on July 19.

Police received a report of a possible drunk driver in a pickup truck on Star Island Drive at about 9 a.m. When police arrived at the corner of Star Island Drive and West Lake Drive, they spoke to the caller who said a Toyota Tundra almost hit his vehicle and the sign at the entrance to Star Island. A few minutes later, police found the Tundra at the end of the road. They said the vehicle was in reverse with the brakes applied and the driver was slumped over the wheel.

The officer knocked on the window and Fagan woke up, but his vehicle started rolling backwards. Police told him to put the vehicle in park and turn off the ignition, which he did.

While police questioned him, they saw a prescription pill bottle in the center console. They said he appeared sluggish, his speech was slurred, his eyes were bloodshot and glassy and his pupils were dilated. He performed poorly on field sobriety tests.

During a search of his truck, police said they found a small, plastic bag containing a white powdery substance that later tested positive for cocaine.

Fagan was charged with felony driving while ability impaired by drugs, due to a prior conviction in 2008, and seventh-degree criminal possession of a controlled substance, a misdemeanor. His truck was impounded under Suffolk County DWI seizure law. Following arraignment, Fagan was released on $2,000 bail.

• Jacob Randall, 21, of Tannersville, N.Y., was arrested on a felony criminal mischief charge after he allegedly hung from a pipe at the Sloppy Tuna in Montauk in the early morning hours on July 19.

Police and the Montauk Fire Department responded to an alarm that went off at the restaurant and bar on South Emerson Avenue at 1:35 a.m. They found a "highly intoxicated" man hanging by his arms from a water pipe in the ceiling in the main bar area — it had broken and sprayed water all over the patrons and the bar floor. The water pipe was part of a fire extinguisher system, police said.

Randall was charged with second-degree criminal mischief. Justice Rana released him on $400 bail.

• Timothy L. Brewer, 54, of Higganum, Conn., was arrested on a charge of boating while intoxicated in Three Mile Harbor on July 20, during the fireworks.

Police said they saw him operating his 2013 Zodiac Cadet 250 in a southwesterly direction in the harbor, south of East Hampton Point, at about 8:45 p.m. He reportedly had no lights or a proper registration number displayed.

Marine patrol units stopped the boat, and Brewer allegedly had a strong odor of alcohol coming from his breath. He was taken to the Gann Road Marine Patrol building where sobriety tests were conducted. Police said he performed poorly on them.

He was charged with recklessly operating a vessel and operating a vessel with a blood alcohol above .08 at about 9:40 p.m., and held for morning arraignment. Justice Cahill released him on $100 bail.

• Jeff A. Dieli, 29, of New York City, was arrested on drunken driving and marijuana charges after an accident on July 19 in Montauk. East Hampton Town police said they received a call from OnStar about an air bag deployment in a 2014 Ford Taurus located on Montauk Highway, near Cemetery Road, at about 1:10 a.m. Police found the car in the eastbound shoulder, facing west. Dieli was standing next to the car, which had hit a guard rail in the westbound lane. He told police he swerved to avoid a deer, but police said he appeared intoxicated. They also said they found a green leafy substance in the center console that later tested positive for marijuana. He was charged with aggravated driving while intoxicated, a misdemeanor — his blood alcohol level was reportedly above .18 — and unlawful possession of marijuana. Justice Rana released him on $300 bail.

• Itamar Gessler, 56, of Fort Lee, N.J., was arrested on a misdemeanor driving while intoxicated charge in Montauk on July 20 at about 2 a.m. Police said they were behind Gessler's vehicle when it crossed into the opposite lane. Justice Cahill released him on $300 bail.

• Camilo Ariza, 26, of Springs, was arrested after police said he failed to stop at a stop sign at the intersection of Three Mile Harbor Road and Tub Oarsman Road, while going 55 mph in a 40 mph zone, on July 20 at about 4:45 a.m. Stopped on Three Mile Harbor Road, near Boat Yard Drive, Ariza appeared intoxicated and was found to be driving with a suspended license. He was charged with DWI and third-degree aggravated unlicensed operation of a motor vehicle, both misdemeanors, at about 5:10 a.m. Police said his license was suspended twice in 2010. Justice Cahill released him on $500 bail.

• Kristin A. Kenny, 31, of Staten Island, was arrested on a drunken driving charge on July 21 in Montauk. Police said she crossed into the opposite lane of travel while making a right onto South Euclid at about 3 a.m. When she was pulled over on Edgemere Street, she appeared intoxicated, police said. Charged with misdemeanor DWI, she was released on $200 bail.

• A 35-year-old East Hampton man was charged with reckless endangerment in the second degree, a misdemeanor, after a domestic dispute on July 19 in Wainscott. According to police, the man and his girlfriend fought and he stopped his Porsche on East Gate Road for her to get out at about 2:20 p.m. As she was exiting the car, he "slammed on the gas while her left foot was partially in the vehicle," police said. The car door closed on her foot, causing her to fall on her hip. She complained of pain in her left foot, ankle and hip. She also had swelling, bruising and cuts. Justice Cahill released him on $1,000 bail the next day.
