Suffolk DA Reviewing Pedestrian's Death in Amagansett

As part of a county-wide policy, the district attorney's office reviews all fatal accidents.

The Suffolk County District Attorney's office is reviewing the accident that killed in Amagansett on June 23. 

Detective Lt. Chris Anderson said it is normal procedure and that the DA's office reviews all fatal traffic accidents as part of a county-wide policy. 

No charges have been filed during the course of the month-long investigation into how Ahn was hit as he walked north on Old Stone Highway with three friends to his family's Amagansett house. Chief Ed Ecker said last month that ."

According to police, Ladislav Smigura was driving a Lindy's Taxi van north on Old Stone Highway to pick up a fare when the side-view mirror clipped Ahn's girlfriend, Penelope Farris. Ahn — who Ecker said last month was in front of Farris in a group of four — was then struck. 

Old Stone Highway has no shoulder and is a curved road.

Smigura, 25, had been driving for Lindy's for several years and had a valid license, Ecker said last month. Police do not believe he was under the influence of drugs or alcohol. The chief also said Smigura had a hands-free device in the van.

Police have not commented about the speed the van was traveling. 

Anderson said the DA's involvement does not mean that the police department's investigation has concluded. "We'll work with the ADA assigned to the case," he said on Tuesday. 

Robert Clifford, a spokesman for the DA's office, confirmed the case is under review. 

Since his death, Ahn's family has set up the Jeffrey Ahn, Jr. Memorial Fund to honor his life "in particular, his caring spirit, his love of the arts, and his abundant school pride," according to the website. Contributions will support a foundation being organized in his name and the new fund at the Trinity School in New York City, where he was a rising senior. 

"We are still trying to understand the circumstances of Jeffrey’s death on the afternoon of June 23, 2012, when he was struck by a vehicle as he was walking towards our home . . .," his family wrote on the website. 

The Ahn family had to make it safer for pedestrians.
