Police Logs: Second DWI Charge for Springs Man in 1 Month

Also: New Jersey man faces felony DWI charge after stop in Amagansett.

The following information was supplied by the East Hampton Town Police Department. A criminal charge is only an accusation and does not indicate guilt.

• A Springs man was arrested after driving drunk with a license that was suspended less than a month ago for the same charge, police said.

Boris X. Penaloza-Alpala, 22, of Springs, was allegedly speeding in a Scion on Springs Fireplace Road — police said he was driving 53 mph in a 30 mph. The car abruptly made a left hand turn onto Underwood Drive without signaling at about 4:20 a.m., police said.

The officer pulled him over and said he appeared intoxicated. Police found that his driving privileges were suspended pending prosecution for a DWI charge. Penaloza-Alpala was arrested on June 6 on an aggravated DWI charge, after police said his blood alcohol level was above .18. He was released on $500 bail.

He was charged with first-degree aggravated unlicensed operation, a felony, and misdemeanor DWI. Justice Lisa R. Rana released him on $5,000 bail.

• Scot W. Edler, 34, of Orangeburg, NY, was arrested on a felony driving while intoxicated charge on July 1 in Amagansett. Police said they saw him going 50 mph in a 30 mph zone on Main Street, near Mainkoma Lane, at about 12:50 a.m. Before police could activate their lights and sirens, Elder pulled over to the right shoulder without signaling. He appeared drunk and performed poorly on sobriety tests, police said. After he was placed under arrest, police discovered he was previously convicted of a DWI in Clarke's Town Court in New York. His vehicle was impounded. His arraignment information was not immediately available.

• Mauricio E. Bahamondes, 44, of East Hampton, was arrested on a misdemeanor DWI charge on June 30 in Amagansett. At about 3:30 a.m., an officer noticed Bahamondes stopped at a steady green light. He made a right turn onto Abraham's Path and crossed over the pavement markings into the shoulder several times. Police pulled him over near Thomas Avenue. He appeared intoxicated and failed all field sobriety tests, police said. Justice Rana released him on his own recognizance.

• Gregory T. Baker, 26, of East Northport, was charged with misdemeanor DWI on June 27 in Montauk. According to police, Baker didn't adhere to a stop sign on South Edison Street, at the intersection of South Elmwood Avenue, at about 1:55 a.m. When police pulled him over, he appeared intoxicated. They said he failed all sobriety tests. He was arrested at about 2:20 a.m. Justice Cahill released him on $350 bail.

• Rolando M. Rodriguez, 43, of College Station, Texas, was arrested on a misdemeanor DWI charge on June 29 in Montauk. An officer was on foot patrol across the street from the Memory Motel on Montauk Highway when he saw a 1999 Ford pick-up truck attempt to back out of a parallel parking spot and hit a parked 2003 Oldsmobile at about 2:50 a.m. The officer walked across the street and spoke to the driver, who smelled of alcohol and had slurred speech, police said in the report. Justice Rana released Rodriguez on $300 bail.

• William P. Jung, 24, of Alvin, Texas, was arrested and charged with misdemeanor DWI in Amagansett on June 29. Police said Jung crossed over pavement markings into the safety zone and then into the shoulder several times while driving west on Montauk Highway, near at the intersection of Atlantic Avenue. Police pulled him over at about 3:25 a.m. Held until morning arraignment, Jung was released on $300 bail.

• Peter Weiler, 21, of Valley Stream, was arrested and charged with operating a motor vehicle impaired by drugs, a misdemeanor, and unlawful possession of marijuana, a violation, after a traffic stop in Montauk on June 27 at 12:30 a.m.

An officer said he was traveling west behind a 2003 Mitsubishi that was speeding at 55 mph in a 40 mph zone on Montauk Highway. When they got into the 55 mph zone, the Mitsubishi sped up to 70 mph, police said. The vehicle was also crossing over the pavement marking, according to the report.

When he was pulled over, police smelled marijuana in the vehicle and the driver appeared to be under the influence. A small bag containing a green leafy substance that later tested positive for marijuana was found in the vehicle, police said. Weiler consented to a blood test, which is being reviewed at the Suffolk County Lab.

Justice Cahill released him on $350 after arraignment.

• Luke A. Garofano, 25, of Pound Ridge, NY, was arrested on a charge of aggravated DWI after he struck a tree in Montauk on June 26 at about 11 p.m. Police said his 2004 Honda Element struck a fence and a tree on West Lake Drive, about 200 feet north of the Wells Avenue intersection. Garofano appeared intoxicated and failed field sobriety tests, police said. Held overnight for arraignment, Justice Cahill released him on $500 bail the next day.

• Emma C. Poli, 20, of Montauk, was charged with drunken driving and having a forged ID on June 27. Police said she was driving south on West Lake Drive, near Old West Drive, when she failed to maintain her lane. Police said she appeared intoxicated and failed sobriety tests. Police said she had a forged Pennsylvania driver's license. She was charged with driving while intoxicated, a misdemeanor, and criminal possession of a forged instrument in the second degree, a felony.

• Diego F. Barahona, 22, of East Hampton, was arrested after police said he was driving drunk and with a suspended license in East Hampton on June 23. Police pulled him over on Stephen Hands Path, near Long Lane, at about 9:15 p.m., after police received a call of a motorist driving erratically. He was charged with on DWI and aggravated unlicensed operation of a motor vehicle in the third degree, both misdemeanors. Police said his license had been suspended that very day. The following day, he was released on $750 bail.

Immigration Warrant Catches Up with Driver

• Juan S. Pulla-Duchi, 28, of Springs, was arrested on a warrant, but also additionally charged with false personation, a misdemeanor, on June 21 in Montauk. Police said he was speeding in a Ford sport utility vehicle on Montauk Highway, near Lincoln Road, at about 7:30 p.m. When pulled over, police discovered a possible immigration warrant for the driver. Police said he originally provided police with a different name. Ultimately, he was arrested and turned over to the Fugitive Squad, police said.

Cops Say Husband Stopped 911 Call

• A 47-year-old East Hampton man was arrested after police said he prevented an emergency call during a domestic dispute on June 24. According to police, the victim said she tried to dial 911, but her husband grabbed the phone from her and hung up. He was placed under arrest the following day, and charged with fourth-degree criminal mischief, a misdemeanor, and second-degree harassment, a violation. Justice Cahill released him on $350 bail.

• Guy K. Tibbets, 31, of East Hampton, was arrested following a domestic dispute on Miller Lane East. Police were initially called there on June 22 at about 11:30 p.m., but Tibbets had left the area. He returned on June 23, and tried to drive away as police arrived. He was pulled over on Three Mile Harbor Road, near Neighborhood House Road, and placed under arrest. Charged with first-degree criminal contempt, a felony, and second-degree menacing, a misdemeanor. It was not clear what weapon Tibbets is accused of using. He is still being held on $2,500 at the Suffolk County jail in Riverside.

Middle Finger Leads to an Arrest

• A 63-year-old Montauk man was arrested after police said he violated a court order that was less than a month away from expiring. According to police, the victim reported that the defendant had given him the middle finger when they passed one another on Industrial Road in Montauk, and then followed him back to his business on Shore Road and pulled up to the driver's side door of his vehicle. The man was charged with second-degree criminal contempt, a misdemeanor, on South Fairbanks Street on June 21 at about 2:45 p.m. He was released on an appearance ticket. An order of protection was issued Jan. 10, 2013, and was due to expire on July 10.

Owner Finds Stolen Bike Despite Fresh Coat of Paint

• Police said a 17-year-old stole a bicycle from the side of a shed in the backyard of Gardiner Avenue house in Springs on June 27. The owner of the bicycle's wife saw the teen with his Cannondale M300 men's mountain bike the following day. The woman stopped the teen on Springs Fireplace Road and called police. The bike, which had once been red, was spray painted blue, but the handlebars were curved upward, leading the woman to recognize the bicycle, police said. The owner of the bike was called to the scene to identify the bike. The teen was placed under arrest at 9:55 a.m., and charged with petty larceny and fourth-degree criminal mischief, both misdemeanors. He was released to his aunt with an appearance ticket. Police withheld the teen's name because he is eligible for youthful offender status.
