Police: Man Shoots, Stabs Mother of His Children

Charges against Sabas Martinez could be upgraded if he is indicted.

A man with a history of felony arrests is being held without bail on Monday morning after he allegedly attacked the mother of his three children in her home on Squaw Road in Springs on Sunday, stabbing her with a kitchen knife and shooting her with an air rifle.

East Hampton Town police said Noemi Sanchez called 911 at 1:30 a.m., and told them she had been attacked in her bedroom at 16 Squaw Road by her estranged boyfriend, Sabas Martinez, 39. "Sanchez was shot in the head with an air rifle, assaulted, and stabbed several times with a kitchen knife before she was able to get free with the help of her daughters."

When police, including East Hampton Village officers, arrived they found Martinez in the kitchen with self inflicted stab wounds to the neck and wrists. After a brief struggle with officers, he was subdued.

On Monday morning, Martinez was arraigned before Justice Catherine A. Cahill, where it was revealed he is a felon who remained in the country after being released on bail by immigration officials, according to his statement in court. His neck and wrist were bandaged as he appeared before the justice.

Justice Cahill arraigned him on two felony charges of first-degree burglary and first-degree assault, as well as four misdemeanors -- two counts of criminal possession of a weapon and two counts of endangering the welfare of a child.

"Based on the fact that you have more than two prior felony convictions, you are going to be sent to jail," Justice Cahill said.

"Why do I not qualify for bail?," Martinez asked her.

"The law is written for a person with that many convictions . . .," she said.

Justice Cahill also served him with an order of protection that prohibits him from any contact with his estranged girlfriend and their children.

There was allegedly an existing order of protection out of family court and history of domestic violence.

The district attorney's office served him with grand jury notice.

Martinez was not represented at his arraignment, and Justice Cahill said she would contact Legal Aid to defend him when he appears before her again on Thursday.
