Village police had pulled him over in the parking lot because his Nissan Altima's windows were so darkly tinted. Ebanks was described as being anxious and nervous as police questioned him about the smell of marijuana coming from his car. "Operator said he smokes weed, but had not smoked at all today, and that the smell was in the vehicle from a past time smoking," the police report said.

Police said the obtained permission to search the passenger compartment, and while doing so, Ebanks became more nervous, once yelling, there was no marijuana in the car, that the police were harassing him, and that if it were anywhere it would be in the trunk, police said. Police detained him for safety reasons, they said, and continued the search.
