Cops: Montauk Man Menaced Woman with Pistol In Front of Their Kids

Also: East Hampton Town police report several DWI arrests.

The following information was supplied by the East Hampton Town Police Department. A criminal charge is only an accusation and does not indicate guilt.

• A Montauk man was arrested after he menaced a woman with a pistol during a domestic dispute on New Year's Eve. In an apartment on West Lake Drive, at around 9:25 p.m., the 29-year-old man brandished what appeared to be a pistol. His 2-year-old daughter and 4-year-old son were home at the time. When the woman tried to call for 911, he grabbed her cellphone He then fled. Police searched for him, and found him later, charging him with second-degree menacing, two counts of acting in a manner injurious to a child, and fourth-degree criminal mischief, all misdemeanors, and second-degree harassment, a violation. He was held on $1,000 cash or $2,500 bond at the Suffolk County jail in Riverside.

• Oscar D. Herrera-Loaiza, 48, of East Hampton, was arrested on a misdemeanor aggravated driving while intoxicated charge on Jan. 1 at about 3:25 a.m. Police said he was unable to maintain his lane of travel while driving a 2002 Saturn south on Springs Fireplace Road, near Abraham's Path. While making a right turn onto Abraham's Path, he crosse into the oncoming lane. His blood alcohol level was allegedly above .18. He was released later that day on $500 bail.

• Derek Smith, 34, of East Hampton, was arrested on a drunken driving charge on Jan. 5 at about 4:50 a.m. He was allegedly driving a 1997 Toyota north on Three Mile Harbor Road, near Abraham's Path, when police said they saw him fail to keep right, by swerving across his lane and into the oncoming lane. Police also said he appeared to have been involved in a previous accident. He was stopped on Three Mile Harbor-Hog Creek Road, near Copeces Lane, in Springs, and appeared intoxicated. He was charged with misdemeanor DWI and released on his own recognizance. Police said he had struck a tree and then a mailbox on Glade Road as he turned westbound on Woodbine Drive. No one was injured.

• Daniel A. Gomez, 24, of East Hampton, was arrested on a drunken driving charge on Jan. 1 at about 2:50 a.m. Police said he was driving south on Old Stone Highway in a 2007 Chevrolet with defective license plate lamps. He was pulled over at the intersection of Ed Hults Lane, an appeared to be intoxicated. He was charged with driving while intoxicated, a misdemeanor, and held on $750 cash, $2,000 bond bail.

• Wilson X. Pena-Tacuri, 24, of East Hampton, was arrested and charged with misdemeanor DWI on Jan. 1 at about 5:20 a.m. Police said they saw him driving a 2002 Honda south on Springs Fireplace Road. He failed all field sobriety tests and was placed under arrest. His bail was set at $500 and he was turned over to the Suffolk County Sheriff's office.

How about "alledgedly" 2 & 4 yr old are not witness qualified .. and claims by a significant other are only " allegations" so how about using the proper outside the happening recerences .. "allegedly" is so much more journalistic for a NEWS ORGANIZATION - and not a gossip blog. .. ? Journalism comes with responsibility .. So was it a pistol ? Inquiring minds want accurate reporting .
