Man Charged with DWI in Route 114 Crash Arraigned Wednesday

William Hurley released on $10,000 bail; More charges may be filed against him.

William Hurley, who police said was behind the wheel of a pick-up truck that hit a car on Route 114 in East Hampton, injuring a woman and her six-year-old son on Saturday afternoon, was arraigned on a drunken driving charge in East Hampton Justice Court on Wednesday, but he may face more charges.

Just one day after the 60-year-old Sag Harbor man was released from Stony Brook University Hospital, he appeared in court to face the misdemeanor charge with his attorney Edward Burke Jr. He was released after posting $10,000 bail, set by Justice Catherine A. Cahill. The Suffolk County District Attorney's office requested $25,000.

His blood alcohol level was reportedly .14.

Meanwhile, the other driver, Elizabeth Krimendahl, a 53-year-old from New York City, was released from the hospital on Monday, a hospital spokesman said. According to police, she was seriously injured. The driver's side of her BMW was completely smashed in and firefighters had to extricate her from it. She was flown to Stony Brook University Hospital.

Her son was taken to Southampton Hospital right after the accident and then transferred to Stony Brook hospital for what police described as serious injuries. It is not clear if he is still in the hospital. East Hampton Town Police Detective Lt. Chris Anderson said his department has not received an update on his condition.

Burke said his client is still reeling from the accident. "He is emotionally torn apart by the whole thing," Burke said.

He said he is preparing for additional charges to be filed.

An indictment on vehicular assault charges is possible.

Anderson would not confirm the type of charges Hurley could face, but said, "The investigation is continuing. The case is under review in conjunction with the Suffolk County District Attorney's office."

In 2012, DA Thomas Spota founded a Vehicular Crime Unit under the Major Crimes Bureau that is made up of "specially trained prosecutors who oversee the investigation and prosecution of serious vehicular felonies," the DA's website states.

Burke said his client has never been arrested before and that he is still recovering from significant injuries to his back and neck. Hurley is an East Hampton business owner. In fact, his business, Peconic Beverage on Pantigo Place, is a stone's throw from the justice court complex.

Hurley's license has been suspended pending the outcome of the case. "He will honor each and every mandate the court puts upon him," Burke said.
